Terms of Service
Last updated:
This is a template for review by legal counsel before launch — not legal advice.
These Terms of Service ("Terms") govern your access to and use of the Piktor website and the application at app.piktor.co (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it.
The service
Piktor turns a flat product shot into photoreal on-model imagery. Features, limits, and pricing are described on our site and may change as the product evolves.
Accounts and eligibility
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account details, for keeping your credentials secure, and for all activity under your account. Tell us promptly at hello@piktor.co if you suspect unauthorized use.
Plans, billing, and renewals
Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. Fees are non-refundable except where required by law. We may change prices with notice that takes effect at your next renewal. Free plans are offered as-is and may change or end. You are responsible for any taxes we do not collect.
Acceptable use
You agree not to:
- upload content you do not have the rights to use, or that infringes others' intellectual property or privacy;
- generate imagery that is unlawful, defamatory, or deceptive, or that depicts a real person without their permission;
- create sexual, hateful, or otherwise harmful content, or any content involving minors;
- misrepresent AI-generated imagery in a way that is unlawful or deceptive;
- probe, scrape, overload, or reverse-engineer the Service, or resell it except as expressly permitted.
Your content
You keep all rights in the product shots and other materials you upload ("Input"). You grant Piktor a limited licence to host and process your Input solely to operate the Service and generate your results. You are responsible for having the rights to everything you upload.
Ownership of generated images
Subject to your compliance with these Terms and payment of applicable fees, you own every image the Service generates for you and may use it commercially — no model releases, no licensing, no royalties. We claim no ownership of your outputs. Because outputs are AI-generated, similar results may be produced for other customers, and rights in AI-generated works can vary by country.
Our intellectual property
The Service — including its software, models, design, and brand — belongs to Piktor and its licensors. These Terms grant you no rights in them beyond the right to use the Service as described.
Third-party services
The Service may integrate with third parties such as payment and analytics providers. Their terms and privacy practices govern your use of those services.
Disclaimers
The Service is provided "as is" and "as available." AI output may contain errors or artefacts, and you are responsible for reviewing images before you publish them. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose.
Limitation of liability
To the maximum extent permitted by law, Piktor will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.
Indemnification
You agree to indemnify Piktor against claims arising from your Input, your use of generated images, or your breach of these Terms.
Term and termination
You may cancel at any time from your account. We may suspend or terminate access if you breach these Terms or use the Service in a way that creates risk. On termination your right to use the Service ends; provisions that by their nature should survive will survive.
Changes to these terms
We may update these Terms as the Service evolves. Material changes take effect when posted, with the date above updated; continued use means you accept them.
Governing law
These Terms are governed by the laws of the jurisdiction in which Piktor is established, without regard to conflict-of-laws rules. [Placeholder — confirm the governing law and venue with counsel.]
